Sick Leave in Germany

Navigating sick leave in Germany involves understanding a structured framework that ensures employees are supported during times of illness. Here’s an overview of the essential aspects of sick leave regulations in Germany as of 2024.

Paid Sick Leave Overview

In Germany, employees enjoy the benefit of paid sick leave. For the initial six weeks of illness, employers are responsible for paying the full salary. This is known as “continued remuneration” (Entgeldfortzahlung). After this period, publicly insured employees are eligible for sick pay (Krankengeld) from their health insurance for up to 72 weeks for the same illness. Sick pay usually amounts to 70% of the gross salary or 90% of the net salary, subject to contributions for unemployment insurance, long-term care, and pension insurance.
For privately insured individuals, a daily sickness allowance (Krankentagegeld) might be available depending on their policy. Self-employed and freelancers need to cover their own financial losses during sickness unless they have private insurance that includes a daily sickness allowance.

Sick Note Requirements

A doctor’s note is required by the fourth working day of illness, though companies may request it sooner based on their policies. It’s essential to inform your employer immediately when you’re unable to work, usually through a preferred method of communication specified by your company. After obtaining a sick note, it’s crucial to forward it to both your employer and health insurance to maintain your eligibility for Krankengeld.

Sick Pay Calculation and Eligibility

The calculation of sick pay considers both gross and net salaries, with a maximum daily cap. The amount of Krankengeld is designed to ensure that employees can sustain themselves financially during longer periods of illness. However, high earners might find the sick pay insufficient, prompting some to opt for private sick pay insurance or to negotiate additional support from their employers.

Sick Leave Duration

Employees are typically allowed up to 30 sick days per year without adverse consequences. Extending beyond this, especially repeatedly, may lead to termination. Furthermore, regulations stipulate that you can receive sickness benefits for 78 weeks within a three-year period for the same illness, including the initial six weeks paid by the employer.

Important Steps and Tips

The process involves submitting proof of earnings and a sick note from your doctor to your health insurance company, which calculates your sick pay. It’s essential to ensure timely submission of all necessary documents to avoid delays in receiving your benefits.’

Additional Considerations

Activities that do not hinder your recovery process are permissible during sick leave. However, engaging in any work that could compromise your recovery could have legal and employment consequences.

Understanding and adhering to Germany’s comprehensive sick leave regulations ensure that employees are well-supported during times of illness, fostering a healthier and more productive workforce. For those navigating sick leave in Germany, staying informed about your rights and responsibilities is key to a smooth recovery process.
