An Employer of Record is a licensed local company that legally employs staff on your behalf in a country where you have no entity: it holds the employment contract under local law, runs payroll, withholds taxes and pays social contributions — while you direct the day-to-day work exactly as if the person were on your own team. You reimburse the EOR for salary and employer costs plus a service fee. It is the standard way to hire abroad without founding a subsidiary first.

Practically, yes — every European market has compliant EOR or equivalent constructs, but the rules differ sharply by country: Germany caps EOR employment at 18 months under its labour-leasing act, France channels it through portage salarial, Belgium restricts labour leasing altogether, and Switzerland requires a SECO licence and Swiss-domiciled provider. Typical European EOR pricing is a flat monthly fee of roughly €200–700 per employee, or a percentage of gross salary — on top of the salary itself and the country’s employer social contributions (from ≈2% employer-side in Romania to ≈45% in France, so the country choice moves the budget far more than the EOR fee). Payroll-only services for companies with their own entity are typically priced per payslip. We flag the realistic all-in monthly number for your target country before you commit to anything.

As a rule of thumb: an EOR wins for the first one to five employees, for testing a market, and whenever speed matters — the hire can start within days instead of the weeks or months an entity takes. Your own entity wins once the team grows, when you need to sign local contracts and invoices, or where local law caps EOR duration (Germany: 18 months). The clean playbook is EOR as the bridge with the entity switch mapped in advance — our partners handle both ends, including the transfer of employees.

In the US model, a PEO co-employs staff on your existing local entity, while an EOR employs them fully so you need no entity at all. In Europe the label matters less than the construct: most European countries have no true PEO regime, so what providers sell as “PEO” is legally either EOR employment or outsourced payroll and HR administration on your own entity. Via EOR, a compliant local employment contract is typically ready within three to five working days once the candidate’s documents are complete — the registrations, payroll setup and insurances run through the partner’s existing infrastructure. In practice the binding constraint is usually the candidate’s notice period with their current employer, one to three months for most European professionals. As recruiters, managing exactly that phase — keeping signed candidates committed until day one — is our core craft.

Yes. Most European countries actively police disguised employment — Scheinselbstständigkeit in Germany, false self-employment audits elsewhere — and a reclassified contractor means back-dated social contributions, largely at your expense. If the working reality is employment, EOR employment costs little more and removes the risk; our partners also audit and convert existing contractor setups.
